ChemTree Games (“ChemTree Games,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains what personal information we collect when you visit our website or contact us, how we use it, who we share it with, and the rights you have over it.
This policy applies to chemtreegames.com and any related pages we operate (the “Site”). It does not apply to third-party websites or services we link to. By using the Site, you agree to the practices described in this policy. If you do not agree, please do not use the Site or submit information to us.
1. Who We Are
ChemTree Games is an independent game studio based in Utah, United States. If you have any questions about this policy or your personal information, you can reach us at support@chemtreegames.com.
2. Information We Collect
We collect only the information you choose to give us. Specifically:
Mailing list sign-ups. When you subscribe to our mailing list, we collect your email address. This is provided voluntarily by you.
Contact-form submissions. When you contact us through the Site, we collect your name, email address, and the contents of your message, plus any other information you choose to include.
Information collected automatically. We aim to run a privacy-respecting Site. We do not use third-party advertising trackers or behavioral analytics. Our web host and infrastructure providers may automatically process limited technical data (such as IP address and basic request logs) as a normal and necessary part of delivering and securing the Site. We use only cookies and storage that are strictly necessary for the Site to function. If we add analytics or non-essential cookies in the future, we will update this policy and, where required, ask for your consent. We do not knowingly collect special or sensitive categories of personal data.
3. How We Use Your Information
We use the information we collect to:
- Send you our newsletter and product updates, if you subscribed (you can unsubscribe at any time);
- Respond to your contact-form messages, questions, and support requests;
- Operate, maintain, secure, and improve the Site;
- Detect, prevent, and address technical issues, abuse, or fraud;
- Comply with our legal obligations.
We will not use your contact-form information to add you to our marketing list unless you separately opt in.
4. Legal Basis & Consent
Where applicable law requires a legal basis for processing, we rely on your consent (for marketing emails, which you may withdraw at any time), our legitimate interests (responding to inquiries, securing the Site, running our business), and legal obligation (where we must process data to comply with the law). You can withdraw consent for marketing at any time by clicking “unsubscribe” in any email or emailing us at support@chemtreegames.com. Withdrawing consent does not affect processing carried out before withdrawal.
5. How We Share Your Information
We do not sell your personal information, and we do not “sell” or “share” it as those terms are defined under applicable privacy laws. We do not trade your data for money or other value, and we do not share it for cross-context behavioral advertising. We share information only with service providers who process it on our behalf, under contract, and only as needed:
- Resend — our email delivery provider. We use Resend to store mailing-list email addresses and to send newsletters, transactional, and contact-related emails, as our processor.
- Hosting & database infrastructure — we store mailing-list and contact-form data in our own PostgreSQL database hosted with our infrastructure provider(s).
We may also disclose information if required by law, to respond to lawful requests from public authorities, to enforce our terms, or to protect the rights, property, or safety of ChemTree Games, our users, or others. If we are ever involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction, and we will notify you of any change in control or use of your data.
6. Data Retention
We keep personal information only as long as necessary. We retain mailing-list emails until you unsubscribe or ask us to delete your data (we may keep a minimal suppression record to honor your unsubscribe request). We retain contact-form submissions for as long as needed to handle your inquiry and for a reasonable period afterward for our records and legal purposes, then delete or anonymize them. We may retain certain information longer where required to comply with legal obligations, resolve disputes, or enforce our agreements.
7. Data Security
We take reasonable technical and organizational measures to protect your personal information against loss, misuse, and unauthorized access, including secure transmission (HTTPS), access controls, and working with reputable service providers. No method of transmission or storage is ever 100% secure, however, and we cannot guarantee absolute security. If we become aware of a data breach affecting your personal information, we will notify you and the relevant authorities where required by law.
8. Your Privacy Rights
Depending on where you live, you may have rights over your personal information. We honor these requests regardless of where you live, to the extent practical.
Utah Consumer Privacy Act (UCPA). If you are a Utah resident, the UCPA gives you the right to confirm whether we are processing your personal data and access it; to delete personal data you provided; to obtain a portable copy of the personal data you previously provided, where technically feasible; and to opt out of the processing of your personal data for targeted advertising or the sale of personal data. We do not engage in targeted advertising or sell personal data, so there is nothing to opt out of — but the right is yours regardless. We will not discriminate against you for exercising any of these rights.
Other U.S. and international residents. If you live in another state or country with privacy laws (for example, other U.S. state privacy laws, the EU/UK GDPR, or similar), you may have comparable rights — such as the right to access, correct, delete, port, or object to certain processing of your data. We aim to honor all valid requests.
How to exercise your rights. To make any request, email us at support@chemtreegames.com with the details of your request. We may need to verify your identity before acting — typically by confirming you control the email address associated with the data. We will respond within the timeframe required by applicable law (under the UCPA, generally within 45 days, with the possibility of a 45-day extension where reasonably necessary). If we decline a request, we will explain why. You also have the right to lodge a complaint with the Utah Attorney General or your local data protection authority.
9. Children's Privacy
The Site and our services are not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, please contact us at support@chemtreegames.com and we will delete it promptly.
10. Third-Party Links
The Site may link to third-party websites or services (for example, storefronts where our games are sold, or our future social media pages). We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any site you visit.
11. International Users
ChemTree Games is based in the United States, and your information will be processed and stored in the United States and potentially in other countries where our service providers operate. Data protection laws in these countries may differ from those in your country. By using the Site or submitting information to us, you understand that your information may be transferred to and processed in the United States. Where required, we take steps to ensure such transfers are lawful.

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will update the “Effective date” above and, where appropriate, notify you. Your continued use of the Site after changes take effect constitutes acceptance of the updated policy.
